We collect the information you give us when you contact us, request a quote, create an account or place an order, plus limited technical data from cookies and similar tools. We use it to deliver our services, support you, process payments, improve our website and, where permitted, market to you. We do not sell your personal information for money. You can ask us to access, correct or delete your data at any time by emailing [email protected].
This Privacy Policy explains how Spark Digital Marketing Solutions LLC ("Spark", "we", "us" or "our") handles personal information when you visit sparkdms.com, our Support Center at support.sparkdms.com, or use our services. Our services include website development, eCommerce solutions, branding and identity, website care and support plans, mobile apps, the Startup Foundation program and related digital marketing work.
Spark is the controller of the personal information described in this policy. Our address is 1267 Willis St, Suite 200, Redding, CA 96001, United States.
When we build or maintain a website for a client, we may process personal information about that client's own visitors or customers on the client's instructions. In that case the client is responsible for its own privacy policy, and we act as its service provider or processor.
If you are in the European Economic Area or the United Kingdom, we rely on these legal bases:
We use cookies and similar tools to keep you signed in, remember your choices, understand how our website is used and measure our advertising. The main tools we use are:
| Tool | Provider | Purpose |
|---|---|---|
| Essential site cookies | Spark | Sign-in sessions, checkout steps and security. Required for the site to work. |
| Google Analytics and Google Ads (gtag) | Google LLC | Site analytics and measuring ad conversions. |
| Meta Pixel | Meta Platforms, Inc. | Measuring and personalizing Facebook and Instagram ads. |
| Microsoft Clarity | Microsoft Corporation | Heatmaps and session recordings to improve usability. Clarity masks text typed into form fields by default. |
| Trustpilot widget | Trustpilot A/S | Showing customer reviews. |
| Font Awesome | Fonticons, Inc. | Loading website icons. |
| Social proof notifications | ProofFactor | Showing recent activity notifications on some pages. |
| Cookie consent tool | Enzuzo Inc. | Recording your cookie choices. |
Your choices: you can manage non-essential cookies through our cookie banner or settings where available, through your browser settings, and through these tools: Google Analytics opt-out, Google Ad Settings and Meta ad preferences. Blocking essential cookies may stop parts of the site, such as sign-in and checkout, from working.
We do not sell personal information for money. We share it only as described below:
Some advertising cookies, such as the Meta Pixel and Google Ads, may count as "sharing" or "targeted advertising" under certain US state laws. See section 13 for how to opt out.
We never see or store your full card number. Card payments for orders placed on sparkdms.com are processed by Stripe through our affiliated company Catchy Clouds Creative Ltd, which acts as our payment partner. Because of this, your payment page and card statement may show the Catchy Clouds name rather than Spark. Stripe processes your payment details under its own privacy policy. We and our payment partner receive limited information such as your name, email address, the amount paid, the payment status and, for subscriptions, the renewal schedule.
Where we offer other payment methods, such as bank transfer or cryptocurrency, the relevant provider processes your payment under its own terms and privacy policy.
To build, fix or maintain websites, we may need logins for your website, hosting, domain or third-party tools. We ask you to share these through secure methods and never through our order forms. We use this access only to perform the work you requested, limit it to the team members who need it, and recommend that you change or revoke the access when our work ends. Your website may itself contain personal information about your customers. We handle that information only to perform our services and keep it confidential.
Spark is based in the United States, and our team members and service providers may be located in other countries. This means your information may be processed outside your country, including in the United States. Where the law requires it, we use appropriate safeguards for these transfers, such as the European Commission's Standard Contractual Clauses or equivalent measures.
We use reasonable technical and organizational measures to protect personal information, including encrypted connections (HTTPS), access controls, protected password storage and limited staff access. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If we become aware of a data breach that affects your personal information, we will notify you and the authorities where the law requires.
Depending on where you live, you may have the right to:
To make a request, email [email protected] with the subject line "Privacy request". We may need to verify your identity before acting on it. We respond within the time required by law, usually within 30 to 45 days. You may use an authorized agent, who must provide proof that you authorized them. We will not discriminate against you for exercising your rights.
Residents of California and other US states with privacy laws (such as Colorado, Connecticut, Virginia, Utah, Texas and Oregon) may have the rights listed in section 12, plus the right to opt out of the "sale" or "sharing" of personal information, targeted advertising and certain profiling.
To opt out of sharing or targeted advertising, use the cookie settings on our website where available, or email [email protected] with the subject line "Do not sell or share my personal information".
If you subscribe to our newsletter or are a client, we may send you emails about our services and offers. Every marketing email includes an unsubscribe link. You can also email us to opt out. We will still send service messages about your orders, account and subscriptions. If you contact us by WhatsApp or phone, we use your number to reply and to support your project, and we will not add you to promotional messages without your agreement.
Our website and services are intended for businesses and adults. We do not knowingly collect personal information from children under 16. If you believe a child has given us personal information, please contact us and we will delete it.
Our website links to other sites, such as our Support Center, social media pages, Trustpilot and partner websites. Their privacy practices are their own, and we encourage you to read their policies.
We may update this policy from time to time. We will change the "Last updated" date above and, for significant changes, notify clients by email or through a notice on our website.
